Explanations and Definitions

The products offered by our shop are primarily intended for traders as defined in Section 14 (1) of the German Civil Code (BGB).

A trader according to sec. 14 (1) German Civil Code (BGB) means a natural or legal person or a partnership with legal personality who or which, when concluding a legal transaction, acts in exercise of their trade, business or profession. Doctors are also traders in this context.

The following cancellation policy only applies to consumers. A consumer according to sec. 13 German Civil Code means every natural person who enters into a legal transaction for purposes that predominantly are outside the consumer’s trade, business or profession.

Right of Withdrawal

If you have purchased as a consumer, you have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.

To exercise the right to cancel, you must inform us (HEINE Optotechnik GmbH & Co. KG, Dornierstr. 6, 82205 Gilching, Germany, Phone: +49 8105 7728 0, E-Mail: webshop@heine.com) of your decision to cancel this contract by a clear statement (e.g. by letter or e-mail).

You can use the attached sample withdrawal form, but this is not mandatory. To meet the withdrawal deadline, it is sufficient for you to send your notification of exercising your right of withdrawal before the withdrawal period has expired.

You can also exercise your right of withdrawal online under "Withdraw contract" (withdrawal button available at shop.heine.com). If you use this online function, we will immediately send you an email confirming receipt, containing details of the content of your withdrawal notice as well as the date and time of its receipt.

Exclusion of the Right of Withdrawal

Unless otherwise agreed by the parties, the right of withdrawal does not exist for contracts for the supply of goods that are not pre-fabricated and the production of which is governed by an individual choice of, or decision by, the consumer, or that are clearly tailored to personal needs of the consumer.

Consequences of Revocation

If you withdraw from this contract, we shall reimburse all payments received from you, including delivery costs (except additional costs arising from your choice of a delivery method other than the least expensive standard delivery offered by us), within 14 days of being informed of your decision to withdraw.

We will use the same means of payment that you used for the original transaction unless expressly agreed otherwise. Under no circumstances will you be charged any fees for this repayment. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is earlier.

You must return the goods to HEINE Optotechnik GmbH & Co KG, Wareneingang, Dornierstr. 6, 82205 Gilching, Germany, without undue delay and no later than fourteen days from the day on which you notify us of the withdrawal. The deadline is met if you send the goods before the fourteen-day period expires.

You bear the direct costs of returning the goods. You are only liable for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.
